By accessing or using this website (the “Site”), you agree to be bound by this Agreement in full. If you do not agree to these terms, please do not use the Site.

1. Eligibility and Legal Age

You represent and warrant that you are at least 21 years of age and legally permitted to purchase alcoholic beverages under applicable law. By using this Site, you acknowledge that alcoholic beverages may only be sold and delivered to individuals who are 21 years or older. Valid government-issued identification may be required at the time of delivery.

Title to all products passes to the purchaser at the time of sale at our licensed premises in New York, regardless of the delivery location. All sales are made in accordance with applicable federal, state, and local laws.

2. Acceptance of Terms

By accessing or using this Site, you agree to be legally bound by the terms of this Agreement, as well as our Privacy Policy, which is incorporated herein by reference.

We reserve the right to modify or update this Agreement at any time without prior notice. Your continued use of the Site following such modifications constitutes your acceptance of the revised terms.

3. Use of the Site

You agree to use the Site only for lawful purposes. You may not use the Site in any manner that:

Violates any applicable laws or regulations;
Infringes upon the rights of others;
Attempts to gain unauthorized access to any systems or networks;
Disrupts or interferes with the security or operation of the Site.

4. Pricing, Availability, and Orders

All pricing, product descriptions, and availability on the Site are subject to change without notice. While we strive for accuracy, we do not warrant that product descriptions or prices are error-free. We reserve the right to cancel any order at our discretion, including but not limited to pricing errors or unavailability of products.

The posting of prices or availability does not constitute a binding offer. Orders are subject to acceptance and confirmation.

Images on the Site are for illustration purposes only. Actual products may vary due to changes in packaging, labeling, or vintage.

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted access.

8. Limitation of Liability

To the maximum extent permitted by law, Oak and Barrel LLC shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising out of or related to your use of the Site or any products purchased from it.

In no event shall our total liability exceed the amount paid by you for the specific product or service giving rise to the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Oak and Barrel LLC, its affiliates, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, or expenses (including attorneys’ fees) arising out of or related to:

Any violation of this Agreement;
Any violation of applicable law or the rights of any third party.

10. Dispute Resolution and Arbitration

Any disputes arising from or relating to this Agreement or the use of the Site shall be resolved through binding arbitration in New York County, New York, in accordance with the rules of the American Arbitration Association. You agree to waive any right to a trial by jury or to participate in a class action lawsuit.

11. Force Majeure

We shall not be held liable for any delay or failure in performance due to events or circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, labor disputes, pandemics, supply chain disruptions, transportation delays, government actions, or telecommunications failures.

12. Third-Party Links

The Site may contain links to external websites or resources. Oak and Barrel LLC is not responsible for the content, availability, or accuracy of any third-party sites and does not endorse or assume liability for them.

13. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of laws principles. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in New York County, New York.

14. Entire Agreement

This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and Oak and Barrel LLC with respect to the Site and supersedes all prior agreements, whether written or oral.

15. Severability and Waiver

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. No waiver of any term shall be deemed a continuing waiver of such term or any other term.

Shipping Terms

Please allow 1–3 business days for order processing. Delivery times are calculated from the shipping date, not the order date.

We are not liable for delays caused by shipping carriers, weather conditions, or holidays. For guaranteed delivery timelines, please select 2-Day or Overnight shipping at checkout. Note: These expedited options may ship on the next business day, depending on processing time.

Shipping charges provided at checkout are estimates. For large or oversized orders, final shipping costs may vary. If there is a significant difference, we will contact you to confirm before proceeding.

Items may not ship in their original box, carton, or packaging unless specifically requested. Additional charges may apply for original packaging.

Orders that are refused or returned after three failed delivery attempts will be refunded for the product cost minus any shipping fees incurred (even if the order qualified for free shipping) and subject to a 15–30% restocking fee.

Returns & Refunds

SPIRITS
Unopened Spirits
Unopened spirits that are free from defects are not eligible for return or exchange. We cannot accept returns for bottles with damaged labels or packaging.Opened and Defective Spirits
Spirits found to be defective may be exchanged for a bottle of equal or greater value. If you choose an item of greater value, you will be responsible for the price difference and any applicable taxes. Store credit is not offered.

All returns are subject to staff inspection to confirm the defect and must be accompanied by a store receipt within 7 days of purchase.

WINE AND SAKE
Unopened Wine and Sake
Proper storage is essential to maintaining the quality of wine and sake. Since we cannot verify how these items are stored after leaving our store, we do not offer refunds or exchanges for unopened wine or sake. Bottles with damaged labels or packaging are not eligible for return.

Opened and Defective Wine and Sake
If you believe a wine or sake is defective, we’re happy to exchange it for a bottle of equal or greater value, provided the return is initiated within 5 days of receipt. You’ll be responsible for any price difference and applicable taxes. We do not offer store credit or refunds.

Note: Wine over 10 years old and special-order items are final sale and not eligible for return or exchange.

All returned items will be evaluated by our staff to confirm any defects. All returns must be accompanied by a store receipt within 7 days of purchase.

Shipped Orders
Please contact us first to confirm if your item(s) are eligible for return shipping. If approved:

Defective bottles must include the original contents and cork for verification.

If your return is approved for a non-defective item, you are responsible for all shipping costs (both outbound and return) and for ensuring that items are securely packaged and arrive in original condition. Unopened returns may be subject to a 15–35% restocking fee.

All returns are subject to evaluation before any exchange or reimbursement is issued.
